O texto enfoca os limites e as possibilidades de reconhecimento das especificidades culturais e socio-históricas dos denominados "remanescentes das comunidades dos quilombos", a partir de um direito constitucional que assegura a regularização de suas terras. O dimensionamento desse problema realiza-se através de uma reflexão sobre a produção de laudos antropológicos, que são requeridos nesses processos de reivindicação de terras fundamentados na aplicação do artigo 68 da Constituição Brasileira de 1988. Partindo de alguns exemplos etnográficos, trazidos nos laudos, trata-se de levantar indicativos que problematizem um certo estereótipo de Quilombo, a constituição de sujeitos políticos e a implementação de projetos. Por último, se discute os paradoxos implicados nas reivindicações dessas comunidades quando procura-se reconhecer a pertinência de uma política de direito à diferença.
The paper discusses the limitations and possibilities of a constitutional law that guarantees the regularization of the ownership of land belonging to the communities denominated "remainders of the communities of the quilombos", coming to represent the aknowledgement of cultural and socio-historical specificities. This issue is examined through a discussion about the anthropological reports required in legal procedures involving claims of ownership of property based on the application of article 68 of the 1988 Brazilian Constitution. Starting with some ethnographic examples present in the reports, the aim is to find indications which can bring under discussion the stereotypes of the Quilombo, the constitution of political subjects and the implementation of projects. Lastly, the paradoxes implied in these communities' claims are discussed, as a policy aknowledging the right to difference is established.
