Resumo

O ensaio busca compreender o papel da função interpretativa no processo de diferenciação do direito na sociedade moderna e questionar a universalização dessa premissa a partir de sua verificação no caso brasileiro. Seu pressuposto é a teoria dos sistemas. As conclusões de Luhmann serão, no entanto, contrapostas à luz da realidade periférica, conforme definida pela teoria dos sistemas alopoiéticos de Neves. Desse questionamento pretende-se esboçar uma hipótese de trabalho sobre o tipo de interpretação jurídica produzida por nosso universo de práticas sociais. Esse tipo de interpretação foi denominado de hermenêutica da cordialidade.

Abstract

This article seeks to analyze the function of the legal interpretation in the differentiation process of Law in modern society and to question the universalizability of this premise in light of the Brazilian case. Its theoretical framework is the systems theory. Niklas Luhmann’s conclusions will be opposed to the peripheral conditions as defined by the allopoietic system’s model from Marcelo Neves. From this questioning will arise a hypothesis on the kind of legal interpretation produced by the social praxis in Brazil. This kind of interpretation will be defined as cordiality hermeneutics.
