O presente artigo tem por objetivo discutir de que forma a reinterpretação do fenômeno do “homicídio por auto de resistência” como signo da chamada “violência policial” e sob o rótulo de “violação de direitos humanos” produz, diferentemente do que esperam teóricos e ativistas de direitos, um argumento desprovido de coerência semântica para o debate público. Procura-se refletir a partir da construção discursiva de “direitos humanos” no campo judiciário para, então, percebê-los a partir das lógicas discursivas dos atores em disputa nessa problemática do “auto de resistência”, discutindo como a linguagem dos direitos é mobilizada nas disputas cotidianas.

The article ‘Don’t Talk to Me about Human Rights’: For an Understanding of the Subject in the ‘Homicide for Resisting Arrest’ aims to discuss how the reinterpretation of the phenomenon of “homicide for resisting arrest” as a sign of so-called “police violence” and under the label of “human rights violation” produces, unlike what theorists and activists expect, an argument devoid of semantic coherence for the public debate. The discursive construction of “human rights” in the judicial field is contemplated so such rights can then be interpreted based on the rationale of the opposing actors in this problem of death justified by “resisted arrest”, discussing how the language of rights is engaged in everyday disputes.
